PREAMBLE
These general conditions govern contractual relations for all distance sales in Metropolitan France only, carried out from the e-commerce site. www.african-avenue.com between :

Hereinafter referred to as “the Company”, and its customers within the meaning of Article L. 121-16 of the Consumer Code hereinafter referred to as “the Buyer”.
These general conditions of sale may be modified at any time and apply to any sale subsequent to their publication on the site. Some of the provisions of these general conditions may be modified punctually, so it is necessary that they be reread before each visit or purchase on the site. www.african-avenue.com . Any purchase on the site is governed by the general conditions applicable on the date of the order. By accessing the site and validating your order, you agree to accept without reservation the general conditions of sale and to respect the articles appearing therein.
ARTICLE 1 - PURPOSE
These General Conditions aim to define the terms of distance selling between AFRICAN AVENUE and the Buyer, from placing the order to delivery of the product, including after-sales service stages.
ARTICLE 2 - PRODUCT INFORMATION AND AVAILABILITY
The products offered for sale by the Company are those appearing on the Company's Website on the day the Buyer consults the Website. The Company presents on its website the products for sale with the necessary characteristics in compliance with Article L 111-1 of the Consumer Code, providing the possibility for the Buyer to know the essential characteristics of the products available for sale before placing their order. In the event of an error or omission in this presentation, the Company cannot be held liable. The photographs and texts illustrating the products have no contractual value.
AFRICAN AVENUE suppliers reserve the right to modify a product during collection. Consequently, AFRICAN AVENUE may be required to deliver to the Buyer an item of the same price, slightly different but of equivalent quality to that described in the corresponding product sheet on the site. In this case, if the Buyer is not satisfied with the product delivered, he/she may use the withdrawal procedure described below consisting of a right of exchange or refund.
The products are offered for sale within the limits of available stocks. In the event of an error regarding the availability of a product ordered, the Company will inform the Buyer by e-mail as soon as possible. The Buyer will have the option of having the product replaced by another of equivalent quality and price, or of cancelling the order.
ARTICLE 3 - PRICE
Product prices are indicated in Euros (€), all taxes included (TTC), excluding participation in preparation and shipping costs. The amount of delivery costs invoiced in addition is specified to the Buyer on the order form before validation of his order.
The prices indicated take into account VAT and any discounts applicable on the day of the order. If the VAT rate were to be modified, these changes could be reflected in the price of the items without the Buyer being informed in advance.
ARTICLE 4 - ORDER
The Buyer undertakes to verify the completeness and accuracy of the information provided when placing an order. The Company cannot be held responsible for data entry errors and their consequences. The costs incurred for the reshipment of the order would be borne by the Buyer.
Any order implies unreserved acceptance of these general conditions of sale, the prices and the descriptions of the products available for sale.
After validation of the order, the Company sends the Buyer a confirmation email to the email address indicated during the order.
The sales contract is concluded under the suspensive condition of receipt of the sale price. In the event of non-payment, incorrect address or other problem with the Buyer's account, AFRICAN AVENUE reserves the right to block the Buyer's order until the problem is resolved.
In the event of unavailability of an ordered product, the Buyer will be informed by e-mail and the cancellation of the order for this product, as well as any refund, will then be carried out.
ARTICLE 5 - PAYMENT

ARTICLE 6 - DELIVERY AND RETURN
Delivery is made to the address indicated by the Buyer when ordering; the Buyer has the option of indicating a delivery address different from the billing address.
Delivery times are given as an indication. A delay will not give rise to a refusal of goods. During sales periods, it is possible that delivery times may be longer than the time indicated on the day the order was placed.
If an item is unavailable, the delivery time may be extended or the order may be split and delivered in several times. In this case, the shipping cost will only be charged for one shipment.
Upon delivery, the customer must check the condition of the packaging of the goods.
In the event of a problem at the time of delivery, he must indicate all useful reservations (damage, missing item, damaged package, broken items, etc.) on the delivery note and contact customer service by email within 24 hours of delivery: contact@african-avenue.com , to notify him of any anomalies noted and allow him to take all necessary action.
In the event of a non-compliant reservation, AFRICAN AVENUE reserves the right to refuse to take charge of the dispute.
Delivery time :
For all orders placed from Monday to Friday (excluding public holidays), delivery will be made in 48 hours to 72 hours.
The delivery time is taken into account from the delivery of the package to the carrier. Orders placed on Saturdays, Sundays and public holidays will be processed from the next working day.
These service times are not guaranteed during certain periods of high activity (sales, summer period, carrier strikes, bad weather, etc.)

The buyer has a right of withdrawal of thirty (30) calendar days from the date of receipt (extended until the first following working day if received on a weekend).
Return costs remain the responsibility of the buyer.
Any product returned incomplete, damaged, used, washed, damaged, deteriorated or soiled will not be refunded or exchanged. Products must be returned intact in their original packaging.
ARTICLE 7 - RIGHT OF WITHDRAWAL
The Buyer has thirty (30) days from receipt of the items to exercise his right of withdrawal, without having to provide reasons or pay penalties, with the exception of the cost of returning the products concerned.
In the event of exercising a right of withdrawal due to a delivery error or product damage attributable to AFRICAN AVENUE, the Company will bear any return costs and initial shipping costs if applicable.
The products must be intact, complete and packaged in the original packaging. If the Buyer does not return the entire order and keeps one or more products ordered, then the amount of the initial delivery costs will be retained by AFRICAN AVENUE.
AFRICAN AVENUE reserves the right to substitute an item of equivalent quality or price. In this case, if the Buyer exercises his right of withdrawal, the return and reshipping costs remain the responsibility of AFRICAN AVENUE.
The company undertakes to reimburse the Buyer who has exercised his right of withdrawal the sums as soon as possible and at the latest within thirty (30) days following the exercise of the right of withdrawal.
ARTICLE 8 - GUARANTEES
All products for sale on the website www.african-avenue.com benefit from the legal guarantee of conformity (L211-1 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing the Buyer to return products delivered that are defective or non-compliant.
The legal guarantee against hidden defects is two years, except in exceptional circumstances. The warranty and after-sales service conditions are communicated by AFRICAN AVENUE customer service, whose contact details are:
- Article L211-4 of the Consumer Code: The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed in his charge by the contract or has been carried out under his responsibility.
- Article L211-5 of the Consumer Code: To comply with the contract, the goods must:
1) Be suitable for the use usually expected of a similar good and, where applicable:
o correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model;
o present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2) Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Damage resulting from a cause external to the product (an accident, shock, lightning, storm, power fluctuation, etc.), from use, installation or connection not in accordance with the manufacturer's specifications or instructions, are not covered by the warranty.
ARTICLE 9 - PERSONAL INFORMATION
The data concerning the Buyer is personal information that is essential for processing their requests. AFRICAN AVENUE undertakes to respect the confidentiality of the personal information communicated to it by the Buyer during their visits to the site. AFRICAN AVENUE nevertheless reserves the right to use these contact details for the purposes of commercial promotions or any other events organized by the Company, and this in strict compliance with the Law on Confidence in the Digital Economy (LCEN).
In application of the "Information Technology and Freedoms" Law (Law of January 6, 1978 amended by Law No. 2004-801 of August 6, 2004), the Buyer has a right to access, modify, rectify and delete data concerning him/her (art. 40 of the amended Law).

In the absence of conciliation, the French courts will have sole jurisdiction.
